doctors and Illinois concealed carry law

As a physician, I just received written notice that as a result of Illinois's new concealed carry law, I am now legally required to report to Illinois DHS any patient" who has been adjucated mentally disabled, admitted to a psych unit within 5 yrs, determined to be a clear and present danger and /or determined to be developmentally disabled or intellectually disabled."
This wording does two things. It gives pretty wide latitude to the doctor as to who qualifies under this wording. It also potentially creates a liability nightmare for the doctor if he fails to report anyone that could fall under this description. Fair warning... any vet going to the VA in Illinois with a diagnosis of PTSD could be reported. Nothing scares a doctor more than a liability lawsuit. Anyone who owns a firearm in Illinois that sees a doctor for mental health issues or especially a psychiatrist,is at risk. Find out how your doctor feels
about this law so you know where you stand with him. If he is anti 2nd amendment,or expresses a fear of lawsuits over this, consider getting a new doctor right away.

Anyone reported will have their FOID card taken away, preventing that person from being in posession of any firearm or ammunition. In Illinois this even includes air rifles with a muzzle velocity over 750 fps.

Fox, I see your liability point, on the flip side do you think there is a liability issue when you report someone from them.

PTSD is NOT a guarantee that someone is going to use a gun, in fact no mental issue is. IIRC PTSD are more likely to take their own lives rather than someone else's.

While we can agree that almost all the folks who have gone off on a shooting spree have been nut jobs, mental illness just like any other illness comes in assorted flavors from the common cold to cancer.

What I fear is a govt out of control and calling everyone crazy. ESPECIALLY veterans. I have 2 papers (both official copies) from West Point and DHS that address among other things the danger in veterans especially those who have seen combat. And its not just veterans that are thrown under the bus, but rather the point is "right wing' folks are nut jobs.

Yes, I think there is liability the other way too. If someone feels they were wrongly identified by a physician and then lost their foid card, they could sue the doctor. I am hopeful that reasonable people will see the problems with this aspect of the law and change it.

Concur. One of the reasons why things are the way they are in that respect is that for many years across the globe governments would just call you crazy or a witch or something and you spend the rest of your life in jail. Looking at the DHS, IRS, NSA and our current gov't view on veterans, gun owners etc this would be a easy way to shut up the right wing side of the house. In fact Chucky Schumer has called for more aggressive clamping down on Tea Party and other conservative groups. NY Gov Cuomo, well I am sure we all know what he said...we are NOT WELCOME in his state.

Our govt now has everything it needs to round us up and control us by taking our rights away. We are fast becoming a country of men rather than a country of laws...

GOOD TO KNOW!

When I had my gangrene gallbladder taken out and spent 10 days in the hospital for what should have been an overnight stay the insurance company kicked me out. I had home nurse visits for two weeks and was asked if I had guns in the house. I respond that if I did I would not tell them. So the below has some merit.

FYI, I am passing this along... there are comments from two other people I have also been asked if we keep guns in the house. The nurse just kinda slipped it in along with all the other regular questions. I told her I refused to answer because it was against the law to ask.

Everyone, whether you have guns or not, should give a neutral answer so they have no idea who does and who doesn't. My doctor asked me if I had guns in my house and also if any were loaded. I, of course, answered yes to both questions. Then he asked why I kept a loaded gun close to my bed. I answered that my son, who is a certified gun instructor and also works for Homeland Security, advised me that an unloaded, locked up gun is no protection against criminal attack.

The Government now requires these questions be asked of people on Medicare, and probably everyone else.

Just passing this along for your information: I had to visit a doctor other than my regular doctor when my doctor was on vacation.. One of the questions on the form I had to fill out was: Do you have any guns in your house?? My answer was None of your damn business!!

So it is out there! It is either an insurance issue or government intervention. Either way, it is out there and the second the government gets into your medical records (as they want to under Obamacare) it will become a major issue and will ultimately result in lock and load!!

Please pass this on to all the other retired guys and gun owners... Thanks. From a Vietnam Vet and retired Police Officer: I had a doctors appointment at the local VA clinic yesterday and found out something very interesting that I would like to pass along. While going through triage before seeing the doctor, I was asked at the end of the exam, three questions:
1. Did I feel stressed?
2. Did I feel threatened?
3. Did I feel like doing harm to someone?

The nurse then informed me that if I had answered yes to any of the questions I would have lost my concealed carry permit as it would have gone into my medical records and the VA would have reported it to Homeland Security.

Looks like they are going after the vets first. Other gun people like retired law enforcement will probably be next. Then when they go after the civilians, what argument will they have? Be forewarned and be aware. The Obama administration has gone on record as considering veterans and gun owners potential terrorists. Whether you are a gun owner, veteran or not, YOU'VE BEEN WARNED!

If you know veterans and gun owners, please pass this on to them. Be very cautious about what you say and to whom.

They are coming for us, so unless you're an ostrich, do not stick your head in the sand.........

Well I finally decided to get a mortgage on my place since not having one can affect your credit score. Its not big, just enough to check the box I have one and making payments on ot. So in doing the mortgage app (over the fone) they now have to ask: WHAT GENDER are you. I asked what does that mean? Well its male, female, Male > Female, Female > Male, and WHAT gender is my partner?

Some mighty good advice in here.
I guess I`ll have a little knowledge when I see My doctors, if I am ever confronted with these questions.

Wonder what they would do if some one put " Hermaphrodite"( both male and female).

Having gone thru this drill many times in my life (wife and I are on our 7th house in 12 years of marriage) no one has every asked except in fone apps whether or not I was single or married. But according to my loan officer they must say "gender", male, female is out and yes there a block to check for TG...
