Administration announces new gun control measures, targets military surplus imports

The Obama administration unexpectedly announced two new gun control measures on Thursday, including one that would curb the import of military surplus weapons -- in a move that could anger collectors.
Vice President Biden announced the new measures Thursday morning. The new rules, announced while Washington was otherwise focused on the crisis in Syria, took the form of executive actions, which President Obama added to the list of 23 steps the White House already determined the president could take on his own.
The steps come after Congress declined to pass any gun control legislation earlier this year despite an aggressive White House push for action in the wake of the Newton, Conn., shooting massacre. With the political world focused on Mideast tensions and looming fiscal battles, the move signaled Obama's intent to show he hasn't lost sight of the issue.
The National Rifle Association, though, ripped the administration, saying its proposals would do little to reduce crime.
"The Obama administration has once again completely missed the mark when it comes to stopping violent crime," the NRA said in a statement.

The following is a list, provided by the White House, of executive actions President Obama plans to take to address gun violence.
1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.
2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.
3. Improve incentives for states to share information with the background check system.
4. Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.
5. Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.
6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.
7. Launch a national safe and responsible gun ownership campaign.
8. Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).
9. Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.
10. Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.
11. Nominate an ATF director.
12. Provide law enforcement, first responders, and school officials with proper training for active shooter situations.
13. Maximize enforcement efforts to prevent gun violence and prosecute gun crime.
14. Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.
15. Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies.
16. Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.
17. Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.
18. Provide incentives for schools to hire school resource officers.
19. Develop model emergency response plans for schools, houses of worship and institutions of higher education.
20. Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.
21. Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.
22. Commit to finalizing mental health parity regulations.
23. Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.

FACT SHEET: New Executive Actions to Reduce Gun Violence

Today, the Obama administration announced two new common-sense executive actions to keep the most dangerous firearms out of the wrong hands and ban almost all re-imports of military surplus firearms to private entities. These executive actions build on the 23 executive actions that the Vice President recommended as part of the comprehensive gun violence reduction plan and the President unveiled on January 16, 2013.

Even as Congress fails to act on common-sense proposals, like expanding criminal background checks and making gun trafficking a federal crime, the President and Vice President remain committed to using all the tools in their power to make progress toward reducing gun violence.

Building on the 23 Executive Actions the President and Vice President Unveiled Last January

Last December, the President asked the Vice President to develop a series of recommendations to reduce gun violence. On January 16, 2013, they released these proposals, including 23 executive actions. With the first Senate confirmation of an ATF Director on July 31, 2013, the Administration has completed or made significant progress on 22 of the 23 executive actions. The new executive actions unveiled today build on this successful effort.
Closing a Loophole to Keep Some of the Most Dangerous Guns Out of the Wrong Hands

Current law places special restrictions on many of the most dangerous weapons, such as machine guns and short-barreled shotguns. These weapons must be registered, and in order to lawfully possess them, a prospective buyer must undergo a fingerprint-based background check.
However, felons, domestic abusers, and others prohibited from having guns can easily evade the required background check and gain access to machine guns or other particularly dangerous weapons by registering the weapon to a trust or corporation. At present, when the weapon is registered to a trust or corporation, no background check is run. ATF reports that last year alone, it received more than 39,000 requests for transfers of these restricted firearms to trusts or corporations.
Today, ATF is issuing a new proposed regulation to close this loophole. The proposed rule requires individuals associated with trusts or corporations that acquire these types of weapons to undergo background checks, just as these individuals would if the weapons were registered to them individually. By closing this loophole, the regulation will ensure that machine guns and other particularly dangerous weapons do not end up in the wrong hands.
Keeping Surplus Military Weapons Off Our Streets

When the United States provides military firearms to its allies, either as direct commercial sales or through the foreign military sales or military assistance programs, those firearms may not be imported back into the United States without U.S. government approval. Since 2005, the U.S. Government has authorized requests to reimport more than 250,000 of these firearms.
Today, the Administration is announcing a new policy of denying requests to bring military-grade firearms back into the United States to private entities, with only a few exceptions such as for museums. This new policy will help keep military-grade firearms off our streets.

They all bother me but this one REALLY bothers me.

If they can ask me if I have guns at home ( to which my response will be " None of your business."). Then shouldn't I be able to ask my doctor and other health care workers if they have any communicable social diseases before any examination? Would they be insulted? Yes! Is it any different? No!

You are exactly right. I can see the wording "does not prohibit doctors" becoming
"requires doctors to ask" before it's over with. You know this is just a start. If they get their foot in this door, it's going to get nasty.

Well, I am a doctor and I ask my patients all the time about their guns. By doing this they sometimes give me insight on where the cheapest and available ammo is. I am also seeing more women than ever carrying handguns in their purses in my office ( this is in Illinois and no concealed carry yet) They happily pull them out and show them to me. I really liked the Bersa 380 , the last one pulled out of her purse. More importantly, I ask them if they are shooting or learning. The woman with the Bersa had been carrying it for a month to protect against an abusive spouse, that is out on bail, after holding her and her daughter hostage in an underground bunker and beating them and cutting them for a week with his hunting knife. She had never fired it. I helped get her set up for a beginning woman's handgun course at the local range. I verified that she would be able to use the gun if the situation arose (she was)
Bottom line, is you have to know and trust your doctor. I never put anything in their medical record that indicates gun ownership.
On the other hand, if I didn't know the doctor and he asked me that, I would not answer and I would find another doctor

Sorry Doc but I have to STEAL this, laughed so hard almost had tears...for a couple of reasons. My Doc told me 'I have to ask this, but I know here in rural Texas all you guys have and carry guns, so do you have any and since I am new here what do you recommend for Texas Whitetail'

We both laughed and the Doc's visit got sidelined on gun talk. He like my AR 10 T

Doc if you didn't live so far away you might have a new patient.
Actually my Doc grew up in Wyoming, has the same two CC liscences that I have. We talk guns but its comparing our likes.
